欧洲国家是现行投资仲裁制度的建立者与开拓者，欧洲投资者也是投资仲裁最频繁的使用者。尽管人们认为欧盟成员国从现行的投资仲裁实践中获益良多，欧盟却正在代表各成员国积极倡导用以多边投资法院制度代替现行的投资仲裁体制，以解决国际投资争端。虽然欧盟提出的方案具有创造性，实现这一目标的途径注定不会平坦。不管是欧盟内部还是在欧盟以外，推进这一改革方案都充满着挑战。
European states were the founders and promotors of the current investor-state arbitration system (ISA) and EU investors have been the most frequent users of the ISA. Supposed to have benefited largely from the existing ISA practice, currently the EU on behalf of the member states, is advocating strongly replacing the ISA with a multilateral investment court system to settle investment disputes. While the EU’s approach is innovative, the path to realise the goal is certainly arduous. EU faces both internal and external challenges in pushing forward its reform strategy.
基于此背景，荷兰鹿特丹伊拉斯姆斯大学法学院的Fabian Amtenbrink教授和李玉文教授将针对欧盟缔结国际投资条约权限所涉及到的宪法以及制度性问题进行深入的剖析，同时，他们也会针对目前国际投资法领域备受关注的，欧盟所倡导的国际投资法院制度从双边向多边的演进轨迹，进行解读。
In this context, Prof. Fabian Amtenbrink and Prof. Yuwen Li at Erasmus School of Law, Erasmus University Rotterdam, the Netherlands, will present insightful analysis on the constitutional and institutional issues concerning EU’s competence in concluding international investment treaties, and the concrete proposal for an international investment court system from a bilateral start to a multilateral end.
